Welcome to Proofser. These Terms & Conditions govern your access to and use of proofser.com, including your communications with us and requests for process serving, legal document delivery, court filing support, address research, and related coordination services.
By accessing this website, submitting a request, or using our services, you agree to these Terms & Conditions.
Website Use
You may use this website only for lawful purposes and in accordance with these Terms & Conditions.
You agree not to use the website in any manner that could damage, disable, interfere with, or impair its operation, security, content, or accessibility.
You may not attempt to gain unauthorized access to the website, its systems, user information, or any connected services.
No Legal Advice
The information provided on this website is for general informational purposes only. It does not constitute legal advice and does not create an attorney-client relationship.
Proofser does not determine your legal deadlines, select the legally appropriate method of service, or provide advice regarding court procedures or legal strategy.
For legal advice concerning your documents, deadlines, service requirements, or case, consult a qualified attorney.
Service Requests
Submitting a contact form, requesting a quote, uploading documents, calling, texting, or emailing Proofser does not automatically create a service agreement or confirm acceptance of an assignment.
An assignment is accepted only after Proofser has reviewed the available information and provided written confirmation of the service terms, availability, pricing, and any required payment arrangements.
All assignments are subject to review, applicable laws, court rules, service requirements, address conditions, document requirements, local field capacity, and the availability of a qualified local process server.
Proofser may coordinate assignments through qualified local process servers and other third-party service providers. Availability and service options may vary by location and assignment.
Client Responsibilities
Clients are responsible for providing complete, accurate, and lawful information and documents needed for the requested assignment. You represent that you have the authority to request the service and that the documents provided may lawfully be served.
You are responsible for verifying filing deadlines, court requirements, service instructions, names, addresses, and all other information related to your assignment.
Fees and Payment
Fees, rush-service charges, mileage charges, skip-tracing charges, additional attempts, wait time, court filing fees, and other costs may apply depending on the assignment. Any quoted price may be subject to change if the scope of work, service location, urgency, or assignment requirements change.
Unless otherwise agreed in writing, payment may be required before services begin. Payments for completed work, attempts, research, rush services, or other incurred costs may be non-refundable where permitted by law.
No Guarantee of Service
We will use reasonable efforts to perform requested services. However, we do not guarantee successful service, a specific result, a specific completion date, court acceptance, or the availability of a particular individual.
Service may be delayed or unsuccessful due to incorrect information, unavailable recipients, restricted access, unsafe conditions, weather, legal restrictions, court requirements, or circumstances outside our control.
Proof of Service
When applicable, Proofs of Service, declarations, affidavits, invoices, and related records may be prepared based on the information available and the services performed. Clients are responsible for reviewing all documentation before filing or using it in any legal proceeding.

This website may include links to third-party websites or services. We do not control and are not responsible for third-party content, policies, availability, or practices.

Limitation of Liability
To the fullest extent permitted by applicable law, Proofser and its owners, employees, contractors, local service providers, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the website or requested services.
This includes damages related to unsuccessful service, recipient unavailability, delayed attempts, missed deadlines, restricted access, incorrect client-provided information, court decisions, third-party actions, or circumstances outside our reasonable control.
To the fullest extent permitted by law, Proofser’s total liability for a claim relating to a specific paid assignment will not exceed the amount paid to Proofser for the service directly giving rise to that claim.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
